At the center of the lawsuit is the Russian Church, which is seeking to overturn a land registration completed in 2023 in favor of a private company called “Nachalat HaNeviim” (Estate of the Prophets). The land, covering approximately 2.8 dunams (2,800 square meters), is currently used largely as a private cemetery.

Nachalat HaNeviim was originally incorporated in Liechtenstein in the 1970s. Its stated purpose was to acquire land, develop and manage private burial plots on Jerusalem’s Mount of Olives, primarily intended for Jews from the Diaspora and private individuals seeking burial on the sacred mountain.

How Did the Russian Church’s Land Dispute on the Mount of Olives Begin?

The roots of the dispute lie in a historic property transaction dating back to 1972. That year, an agreement was signed to sell the compound for $130,000. At the time, the Russian Orthodox Church Outside Russia was headed by Metropolitan Philaret, while its institutions and properties in Jerusalem were effectively managed by the head of the Russian Ecclesiastical Mission, Archimandrite Anthony Grabbe, a colorful figure involved in a series of controversial real estate transactions during that period. Today, the Russian Orthodox Church is headed by Patriarch Kirill of Moscow.

The Church now claims that only $110,000 of the agreed purchase price was actually paid and that there is allegedly no evidence that the transaction was legally completed. Another argument raised by the Church concerns corporate identity: it disputes whether the Nachalat HaNeviim company registered as the landowner in 2023 is indeed the same Liechtenstein company established in 1972.

Why Is the Russian Church Seeking to Reclaim Land in Jerusalem?

Behind the legal arguments lie more complex motivations. Beyond the financial dispute, the case forms part of a broader geopolitical and religious struggle by the Russian government and the Russian Patriarchate to regain control of historic properties in Jerusalem, known as the “White Russian Properties.” The struggle also reflects a desire to prevent strategically located land on the Mount of Olives from passing into Jewish and private hands.

The purchasing company, meanwhile, bases its position on the validity of the historic contract and its actual possession of the land for decades. From its perspective, the 2023 registration was merely the long-overdue formal recognition of its property rights. It also maintains that any claims concerning an unpaid debt dating back to 1972 became time-barred decades ago.

Today, approximately 70% of the land is used for burials. The Church has made clear that it is not seeking to remove existing graves. Instead, the dispute focuses primarily on canceling the land registration and gaining control over the remaining 30% of the property, a valuable reserve of land that has not yet been marketed.

The proceedings before the Jerusalem District Court are expected to determine whether the historic transaction remains legally valid or whether ownership will revert to the Church. The dead, presumably, will hardly notice the difference.

A heated legal battle that has reached the Jerusalem District Court is raising fresh questions about ownership of a unique plot in the heart of the cemetery on the Mount of Olives.
